Wealthy businessman and Ogun state politics strongman,
Kashamu Buruji may not actualize his dream of being a federal lawmaker if the
wish of his party men is granted by the Federal High Court sitting in Abeokuta.
The money bag has been dragged to court by two members of the Ogun state
chapter of the Peoples Democratic Party (PDP) over allegations of certificate
forgery >
The two PDP members, Dele Ajayi from Ward 08 in Ijebu
North local government and Saula Adeniji Wasiu of Ward 003 of Sagamu Local
Government areas of the state are also seeking Kashamu's disqualification from
contesting forthcoming elections "having presented forged or no
certificate" to INEC.
In the suit number FCH/AB/CS/19/2015 filed by the
defendant, the PDP members are seeking an order of interlocutory injunction
restraining the Independent National Electoral Commission (INEC) from
recognizing Kashamu as the candidate of the PDP for the Ogun East Senatorial
District.
They are further seeking an order "setting aside
and/or nullifying the nomination of Kashamu as the PDP candidate for the Ogun
East Senatorial District".
The PDP members also prayed the court for an alternative
declaration that the legitimate candidate and winner of the Ogun East
Senatorial District primary election conducted by INEC "is the next other
candidate who filed and submitted nomination form to apply for, and was
screened by the 2nd Respondent for its primaries for the Ogun East Senatorial
District".
They claimed that Kashamu should be disqualified from
contesting the elections by virtue of the provisions of Section 66 (1) (c) of
the 1999 constitution, "having been charged and/or convicted of an
offense."
They are also claiming that having been convicted of an
offense involving dishonesty, Kashamu is not qualified for nomination as the
candidate of the PDP or any other party and not eligible to participate in the
forthcoming March 28 presidential and National Assembly elections.
Similarly in the originating summons dated February 23rd,
2015, the two applicants in their claims are seeking a declaration by the court
that Kashamu, "is not qualified for nomination to contest election as
candidate of the 2nd Respondent or any registered political party in Nigeria
and not eligible to participate in the March 28, 2015 National Assembly
Election or any future elections conducted by the 3rd Respondent".
They claimed that Kashamu should be disqualified from
contesting the elections by virtue of the provisions of Section 66 (1) (c) of
the 1999 constitution, "having been charged and/or convicted of an
offense."
They are also claiming that having been convicted of an
offense involving dishonesty, Kashamu is not qualified for nomination as the
candidate of the PDP or any other party and not eligible to participate in the
forthcoming March 28 governorship election.
The court has however, fixed March 4th, 2015 for the
hearing of the motion on notice.
